1. The App
NCam is an offline Android camera app for field work and inspections. It burns a watermark — timestamp, GPS location, speed, heading, a selected site address, and an optional QR code — into photos and videos. The App runs entirely on your device and does not require an internet connection or an account.
2. License to use the App
Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own purposes, including professional field work. You may not reverse engineer, resell, sublicense, or redistribute the App except as permitted by the store through which you obtained it or by applicable law.
3. Your responsibility for captured content
You are solely responsible for the photos, videos, notes, and saved places you create with the App, including obtaining any consent required to photograph or record people or private property, and complying with the laws that apply where you use the App. The App stores this content locally on your device; you are responsible for backing it up, securing your device, and managing its storage.
4. Accuracy of watermark data
The watermark is built from your device's GPS, clock, and sensors. GPS accuracy varies with satellite visibility, indoor use, and device hardware, and clocks and location can be manipulated (for example, by mock-location tools) or be briefly unavailable or stale. The App flags known issues — such as a stale GPS fix, a mock-location provider, or a clock that doesn't match the device's network time — directly on the watermark rather than hiding them, but flagging cannot guarantee the underlying data is accurate or that every form of tampering will be detected.
The App is a documentation tool. It does not guarantee that watermarked photos or videos will be accepted as evidence by any court, agency, client, or third party, and you should independently verify that the output meets the evidentiary or contractual standards you rely on it for.
5. Acceptable use
You agree not to use the App to:
- Capture or watermark content for unlawful surveillance, harassment, or invasion of privacy.
- Fabricate or misrepresent a watermark by tampering with your device's clock or location to deceive a third party, beyond ordinary testing of the App.
- Violate the rights of any person or entity, or any law applicable to you.
6. Intellectual property
The App, including its code, design, and branding, is owned by its developer and protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You retain all rights to the photos, videos, and notes you create using the App.
7. No warranty
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No warranty is made that the App will be uninterrupted, error-free, or that GPS, sensor, or watermark data will always be accurate or available.
8. Limitation of liability
To the maximum extent permitted by law, the developer of NCam is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of or inability to use the App, including reliance on watermark data for evidentiary, legal, or contractual purposes.
9. Open-source and third-party components
The App uses open-source libraries (such as ZXing for QR code generation and scanning) under their respective licenses. These components run locally on your device and do not transmit data externally.
10. Termination
This license ends automatically if you uninstall the App or fail to comply with these Terms. You may stop using the App at any time by uninstalling it, which also removes its locally stored settings and saved places.
11. Changes to these Terms
These Terms may be updated from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws applicable to the developer's place of business, without regard to conflict-of-law principles, except where local consumer protection law provides otherwise.
